Introduction
These Terms and Conditions (“Terms”) define the scope of services for vehicle, van, motorcycle, and roadside assistance provided by independent and third-party contractors.
By engaging these services, the client acknowledges and accepts these Terms. Should these Terms not be agreeable, kindly refrain from proceeding with the reservation.
Service Overview
This platform functions as a third-party intermediary, facilitating connections between clients and pre-qualified and authorized vehicle recovery and mobile tire fitting service providers.
Clients are able to request quotations through either telephonic communication or our online platform. Following confirmation, a service provider will be assigned based on their availability, geographical location, and the specific demands of the task.
Non-Refundable Deposit: To secure the services of the chosen provider, a deposit is mandated prior to the commencement of any work. This deposit is unequivocally non-refundable.
Deposits
Deposit Requirement: A deposit is required to secure the services of the provider.
Strictly Non-Refundable: Deposits are non-refundable under all circumstances, including but not limited to client-initiated job cancellations, external influences, or inaccuracies in vehicle information supplied by the client.
Partial Refunds for Service Provider Non-Performance: Should an assigned service provider be unable to fulfill their obligations, a partial refund may be issued at the sole discretion of management. Each such instance will be evaluated individually and a refund is not guaranteed.
Service Provider Responsibilities & Liabilities
Upon receipt of the deposit payment, the customer will be provided with the service provider’s contact information.
The intermediary disclaims responsibility for any disputes arising between the customer and the service provider. Once the service has been arranged, all subsequent communications and requirements must be directed to the service provider.
Service providers function as independent contractors, assuming full responsibility for their actions, performance, and any liabilities stemming from the services rendered. The intermediary entity exercises no control over their operational methodologies or conduct.
Customer Obligations
Accurate Information: Customers are obligated to furnish precise and comprehensive details pertaining to their vehicle and its current state. Omission of essential information may lead to supplementary charges or service refusal without reimbursement.
Driver Coordination: Upon assignment of a driver, the customer is responsible for maintaining effective communication and adhering to all instructions provided for the service.
Vehicle Condition: Customers bear sole responsibility for ensuring their vehicle is in an appropriate state for recovery. Any pre-existing damage or mechanical deficiencies remain the responsibility of the customer.
Damage & Liability
Third-Party Responsibility: All services are performed by independent third-party service providers. Any claims for damages, disputes, or liability concerns must be resolved directly with the assigned driver. The intermediary disclaims all responsibility for damages or disputes once the service provider has been assigned.
Customer Vehicle Inspection: Customers are responsible for inspecting their vehicle both prior to and following the completion of services. Any damage concerns must be promptly reported to the driver.
Limitation of Liability for Service Provider Actions: The intermediary disclaims responsibility for any damages, losses, delays, or inconveniences arising from the actions or omissions of the service provider.
Charges & Payments
Payment Methods: Deposits and payments must be made via approved payment methods, including bank transfers and credit/debit cards.
Chargebacks & Fraud Prevention: Any fraudulent chargebacks will be contested, with all supporting evidence submitted to payment providers.
Bank Transfers Preferred for Large Deposits: Customers are strongly encouraged to make payments by bank transfer for deposits exceeding £150.
Disbursements: In some cases, Golden Recoveries will act as an agent to facilitate your car recovery by subcontracting part or all of the service to independent third-party providers. You agree that we may disburse part of your payment directly to these third-party providers on your behalf. These disbursements are made without markup and will be clearly itemized. You accept responsibility for these costs as part of your acceptance of our services.
Dispute Resolution
Resolution Process: Should a dispute arise, the client is required to first engage in direct resolution efforts with the service provider.
Binding Arbitration: In the event that an amicable resolution cannot be achieved, all disputes shall be settled through binding arbitration in accordance with UK law. Court litigation is not an available recourse unless mandated by legal requirements.
Changes to Terms and Conditions
Policy Updates: These Terms and Conditions are subject to modification at any time. Continued utilization of the service following such updates constitutes acceptance of the revised Terms.
Surge Pricing
Dynamic Pricing Policy: During periods of elevated demand, including but not limited to peak hours, weekends, and public holidays, pricing may experience significant adjustments. This measure is implemented to ensure service availability and to offset increased operational expenditures. Clients will be notified of surge pricing at the point of booking confirmation.
